Acceptable Use Policy

This Acceptable Use Policy explains how ProspectOS must be used responsibly, lawfully and professionally by agencies, branches, Authorised Users and anyone accessing an account.

It forms part of our Terms of Service (see Schedule 2). By using ProspectOS you agree to this policy. If you breach it, we may suspend access, block campaigns or terminate your account.

1. Overview

ProspectOS is a business platform for UK estate and lettings agencies. It is designed for lawful prospecting, direct mail, pipeline management and agency operations — not for spam, harassment, deception or misuse of personal data.

You remain responsible for your agency's compliance with direct marketing law, data protection law, property and agency regulations, and any industry codes that apply to you.

2. Permitted use

You may use ProspectOS to:

  • Run your estate agency or lettings business professionally.
  • Create, review and send lawful marketing campaigns where you have an appropriate lawful basis and permissions.
  • Manage branches, users, permissions and workflows within your subscription.
  • Use ProspectOS Data and tools in accordance with your plan, credits and licence terms.
  • Store and process Customer Data you are entitled to use.
  • Train your staff on approved platform features.
  • Export data you are entitled to access, subject to your plan and these Terms.

3. Prohibited use

You must not use ProspectOS to:

  • Send unlawful direct marketing or contact people who have objected or opted out.
  • Harass, intimidate or target vulnerable people.
  • Mislead recipients about who you are, why you are contacting them, or the nature of your communication.
  • Impersonate regulators, courts, government bodies, banks or official notices.
  • Hide your agency identity where identification is required by law or industry standards.
  • Use personal data to discriminate unlawfully.
  • Upload special category data (such as health or ethnicity data) unless strictly necessary, lawful and agreed with us in writing.
  • Upload excessive, irrelevant or unlawfully obtained personal data.
  • Scrape, harvest or bulk-import data in breach of third-party licences or law.
  • Resell, sublicense or redistribute ProspectOS Data or platform outputs to third parties.
  • Use ProspectOS Data to build or train a competing product or database.
  • Reverse engineer, copy or replicate platform workflows, scoring logic or database structures.
  • Circumvent postcode restrictions, credit limits, approval workflows or security controls.
  • Access another agency's account or data without authorisation.
  • Introduce malware, attempt unauthorised access, or disrupt the platform.
  • Use the Services in any way that could harm ProspectOS, other customers, recipients or third parties.

4. Account security

You must:

  • Keep login credentials confidential and not share passwords between individuals.
  • Use strong passwords and enable any security features we provide.
  • Promptly remove access for staff who leave your agency.
  • Assign role-based permissions appropriate to each user's job function.
  • Notify us promptly if you suspect unauthorised access to your account.

You are responsible for activity under your account, including actions taken by Authorised Users you invite.

5. Data upload responsibilities

You are responsible for the accuracy, lawfulness and appropriateness of Customer Data you upload, enter or use through ProspectOS.

This includes ensuring that:

  • You have a valid lawful basis for processing and contacting data subjects.
  • Suppression and opt-out records are maintained and applied before campaigns are sent.
  • Recipient addresses and names are accurate enough for responsible direct mail.
  • Campaign content is truthful, professional and compliant with ASA/CAP standards where applicable.
  • You do not upload data you are not entitled to use.

6. Misuse of the platform

Examples of misuse include:

  • Sending campaigns without appropriate internal approval where your agency requires it.
  • Deliberately bypassing wallet, credit or billing controls.
  • Using automations to send high-volume unlawful mail.
  • Sharing login access with unauthorised third parties.
  • Using test or demo accounts for live production campaigns without a valid subscription.
  • Abusing support channels, APIs or integrations.

We may monitor platform usage for security, billing, abuse prevention and service quality. We do not routinely review the substantive content of your campaigns, but we may investigate where misuse is reported or suspected.

7. Suspension and enforcement

If we reasonably believe you have breached this policy or applicable law, we may take one or more of the following actions:

  • Issue a warning and request corrective action.
  • Suspend or restrict specific features (for example campaign dispatch).
  • Block pending campaigns or automations.
  • Restrict exports or API access.
  • Suspend or terminate your account.
  • Report serious matters to regulators or law enforcement where appropriate.

We will aim to act proportionately and, where practical, give you notice — except where immediate action is necessary to protect recipients, other customers, our systems or legal compliance.
